Terms of Service

In plain English: keep your key secret, pay for what you use from prepaid credit, and only fetch data you are allowed to fetch and use it lawfully. The data comes from third parties and endpoints can break, so the service comes with no guarantees, and our liability is limited to what you paid us recently.

1. What these terms cover

These terms apply to FetchAPI: the website at fetchapi.co, its HTTP API, its MCP server and the account pages (together, "the service"). FetchAPI gives you one API key that routes calls to third-party data providers, meters each call, and lets you make private data APIs for web pages you choose. By creating an account or a key, or by using the service, you agree to these terms and to our Privacy Policy. If you use the service for an organisation, you agree on its behalf and confirm you may do so.

Each key has a rate limit (calls per minute) and a monthly spending cap, and the service as a whole has a daily spending cap. A call over a limit is refused (rate_limited or budget_exceeded) and not charged. We set these limits and may change them, per key or for everyone, to keep the service working and to protect our provider accounts. Do not try to get around them, for example by spreading one workload over many accounts.

5. Acceptable use

You must not use the service to:

Your data, your responsibility. You decide what data to request and what to do with it. You are responsible for having the right to collect and use it, including under data protection law when it is about people, and under the terms of the site it comes from. Some sources (for example Similarweb, BuiltWith, Crunchbase and Semrush) restrict republishing their data; follow those restrictions.

7. APIs you make

When you make an API, an AI model reads the page you chose and writes a description of how to extract its data. You confirm you are allowed to fetch that page and use its data as described in section 5. The API is private to your account and callable only with your keys. AI output can be wrong; check the results before you rely on them. We may disable an API that breaks these terms or that a site owner credibly objects to.

8. Suspension and termination

You can stop using the service and revoke your keys at any time, and ask us to delete your account. We may suspend or revoke a key or an account, without notice where needed, if you break these terms, if your use puts the service, a provider account or other customers at risk, if a provider or site owner raises a credible complaint, or if the law requires it. If we end your account without you having broken these terms, we will refund unused purchased credit. If we end it because you broke them, unused credit may be forfeited.

9. No warranty

THE SERVICE AND ALL DATA IT RETURNS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE EXTENT THE LAW ALLOWS.

10. Limitation of liability

TO THE EXTENT THE LAW ALLOWS, FETCHAPI IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR US$100 IF THAT IS MORE.

Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or rights you have as a consumer that cannot be waived.

11. Indemnity

If someone makes a claim against FetchAPI because of data you requested or how you used it, or because you broke these terms, you will cover the reasonable costs and losses that result, to the extent the law allows.

12. Changes to these terms

We may update these terms. We update the date at the top, and for a material change we tell account holders by email before it takes effect. If you keep using the service after that, the new terms apply; if you do not agree, stop using it and ask us to refund unused purchased credit.

13. Governing law

[To be decided: the law that governs these terms and the courts that hear disputes.] Until then, we will try to resolve any dispute informally first: email us and give us 30 days to put it right.
